Books Rental Terms and Conditions

PLEASE READ CAREFULLY

American Nurses Association, a Washington, DC nonprofit corporation with principal offices at 8515 Georgia Ave. Suite 400, Silver Spring, MD 20910, and/or its affiliates ("ANA" or "We" or “Us”) offers the Renter (”You” or “Your”) the opportunity to rent textbooks through NursesBooks.org ("Textbook Rental Website") subject to the following terms and conditions ("Rental Terms"). If you choose to rent a textbook through Textbook Rental Website, then you accept the Rental Terms.

Your use of the Textbook Rental Website is also governed by our Privacy Policy, as well as all other applicable terms, conditions, policies, limitations and requirements. In the event of a conflict between the Privacy Policy, Rental Terms or any other applicable terms, the Rental Terms will control only with respect to textbook rentals.

Book Condition

The textbook may be in new or used condition. The used condition books will be in rental condition as determined by ANA.

Book Returns

You agree to return the book on or before the due date, which is 180 calendar days from the date of rental.

You may return the textbook to our return center, subject to our standard product return policies as outlined on FAQs page.

NOTE: The rental fees are non-refundable.

We are not responsible for items that are lost in transit from you to us or for items that are sent to us in error.

After a book is returned, ANA, in its sole discretion, will determine whether the book is in acceptable rental condition. If ANA determines that the returned book is not in acceptable rental condition, then ANA may charge you the buyout price, which is defined as the full list purchase price of the textbook at the time of rental, and ship the textbook back to you to keep.

Automatic Purchase

The textbook you rent must be returned to us within 180 calendar days from the rental date. If the rented textbook is not postmarked on or before the return due date, then you will be charged the full list price of the book and you can keep the book; if the book is returned to us, then we will return it back to you to keep. Rental fees are non-refundable and will not be credited towards the automatic purchase of the book contemplated in this section.

Payment

Under these Rental Terms, you authorize us to charge you for any amounts owed by you to the credit card you used to rent the textbook or, if such credit card is no longer valid, then to any other credit card on file. In your account, you agree to maintain at least one valid credit card that expires no earlier than 210 days after the rental date. If you incur outstanding or unpaid fees for rented textbooks and we are unable to charge any credit card for such fees, then we reserve the right to block or cancel orders and suspend or terminate your account.

Title and Risk of Loss

Title to each rented textbook remains with ANA during the rental period or thereafter. However, if you purchase the textbook or we charge you the buyout price, then the title to the textbook will pass on to you after we charge you the buyout price.

Upon our delivery of the textbook to the carrier (both for the initial shipment and for any return shipments from us to you), the risk of loss is passed on to you. When a book is returned from you to us, the risk of loss passes to us upon our receipt of the textbook from the carrier.

Shipping Availability

Textbook rentals are available only to shipping addresses in the United States (including the continental United States, Hawaii and Alaska, but excluding Puerto Rico and U.S. territories).

Modification to Agreement

ANA, in its sole discretion, may change these Rental Terms or any other policies without notice to you. If any change is found invalid, void, or unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or Rental Terms.
